Prevail Legal, Inc., (“Prevail”) is a Delaware Corporation based in San Diego, CA. We offer a cloud-based testimony management platform (services). We perform these services and maintain records related to our work for the benefit of our customers. We take the privacy of the personally identifiable information and non-public information we collect, process, use, disclose, and retain seriously. In fact, privacy—and the maintenance of confidentiality and client privilege—are core operational values of Prevail. This Privacy Policy (referred to from here as “[T]he Policy”) describes in detail how we treat your data collected through this Website and other sources. It explains your rights regarding that data. It also spells out the related principles, procedures, and processes we employ as the data controller to protect your privacy and govern this Policy. California Law

Prevail Legal, Inc., anticipates it will conduct business with customers who are also residents of California. On January 1, 2020, the California Consumer Privacy Act (CCPA) went into effect. This comprehensive law afforded residents with unprecedented rights, including the right to know whether businesses are selling their information to third parties and to opt out of these sales, and the right to erase information upon request. However, Prevail is currently exempt from complying with this law based on criteria enumerated in the CCPA. If and when this changes, and the exemptions no longer apply, we will amend the Policy to reflect our duties and your rights under the law.

Information from Children

Prevail does not knowingly collect personal information from children under the age of 16. We do not even contemplate forming direct legal and business relationships with children without the involvement or consent of parents or guardians. If we become aware that we have collected personal information from these children without this involvement or consent, we will immediately notify parents and delete the data in question.

Changes to the Policy

The Policy is subject to amendment and revision as needed. We will notify you through any and all available means of pending changes to the Policy and give you the opportunity to consent to the changes. We will publish the effective date of any and all revised versions of the Policy. Any issues with or requests related to the policy that occur before the effective date of the amended Policy will apply to the Policy that was in effect on the operable date.
